Site Use

The following are terms of a legal agreement between you, the viewer/customer, and Spectronics Corporation. By browsing, viewing, shopping, downloading and in any other way accessing or using this site you have acknowledged that you have read and understood the terms of use for this site. You have also agreed to comply with all applicable U.S. laws and regulations, including export.

Spectronics Corporation operates this site from the United States and follows all U.S. laws with respect to commerce and communications regulations. However, Spectronics Corporation makes no representation that materials on this site are appropriate or available for use in other locations, countries or territories where the use of these products may be illegal or prohibited. For those persons accessing this site from other countries you should be familiar with your own local law and you are responsible for adhering to your own applicable local laws.

You are prohibited from posting or transmitting to or from this site any unlawful, threatening, libelous, defamatory, obscene, inflammatory, pornographic material, or any other material that could give rise to any civil or criminal liability under the law.

Spectronics Corporation may at any time revise the "Terms and Conditions" of this site. By using this site, you agree to be bound by such revisions and you should therefore visit this page often to determine the current "Terms and Conditions".

If any provision of the Terms and Conditions or any application thereof is held to be invalid or unenforceable for any reason, that provision shall be deemed severable and the remainder of the Terms and Conditions and the application of that provision in other situations shall not be affected.

If you do not agree to these terms, then you are not granted permission to use or access this site, and any access that you make to this site is unauthorized.

Payment

Payment will be made by either a check mailed to Spectronics, or American Express, Discover, MasterCard or Visa credit card.

You credit card will not be charged until your order ships.

Pricing Specifications and Availability:

Prices, specifications and availability of products are subject to change without notice. Any typographical, photographic or specification error in product, pricing or offers is subject to correction.

Although Internet orders generate an automatic confirmation and response e-mail, Spectronics Corporation may change its pricing, product description or specification after any order confirmation or response e-mail but prior to shipment due to errors, changing market conditions, product discontinuation or unavailability, typographical errors, or any other reason.

We will notify you of any corrections or changes and ask for your approval before we complete your order. We will not complete your order until we have your approval. We reserve the right to limit sales, even after we have received and confirmed your order.

We must collect the proper sales tax for all orders shipped anywhere in the state of Nebraska. Due to sales tax complexities with regards to Nebraska local taxing authorities, we cannot indicate the amount of Nebraska sales tax to be collected on the web site. The proper tax will be computed and added to your order total as we process your order. The dollar amount of sales tax collected will be indicated to you via email and will be shown on the paper invoice you receive with your order.

Shipping

The term used herein as "Free Shipping" only applies to "Ship To" addresses within the continental USA only.

Items ordered with "Free Shipping" will be shipped via "Standard Ground" shipping using the carrier of our choice to the "Ship To" address.

Pre-payment and order entry via the web required to qualify for "Free Shipping". We will take your order via telephone, but we will charge you shipping and handling.

If paying by check, order will ship once check clears.

 Return of Goods

No credit will be issued for any item that has been used or installed.

A request for return must be made in writing within 60 days after receipt of material if material is unsatisfactory. Any merchandise received without prior authorization will be returned to sender.

All non-defective returns will be subject to a 15% restocking fee after 30 days.

All returns must be sent freight pre-paid within 30 days of authorization; call tags will not be issued. Freight credit will not be given for customer errors or non-defective items. Freight will only be credited for Spectronics errors and defective products. Any returns that are sent back "freight collect" will be refused.

Any return received that is not with all original packaging, parts, instructions and labels will be returned to you at your expense. Do not write on or stick labels on the original packaging, as that will make it non-resalable.

Any material and labor cost incurred to repair or refurbish equipment damaged due to transit or handling shall be charged to Buyer in addition to any restocking charge.

Custom special, special ordered or non-stocked equipment cannot be returned for credit.

Credit will not be given until the product in question has been received by Spectronics Corporation.

Should you require immediate replacement of a defective item, we will "cross-ship" a replacement billed to your credit card. Just let us know! Upon evaluation of the defective item we will immediately issue you a credit.

Even though we may offer "Free Shipping", when you return merchandise, you will be charged for our Shipping Costs.

Limited Warranties

Spectronics Corporation does not warrant other manufacturers' products sold. The products are backed by the limited warranties of the original manufacturer only. Consult your product documentation for specific limited warranty information.

Security

Safe, secure ordering is our top priority at Spectronics Corporation. Our customers don't have to worry about credit card safety, because we use the latest in security technology to ensure that personal information is protected at all times.

Our web site takes advantage of Secure Socket Layers (SSL) to encrypt all transactions that require personal information. The industry standard for security, SSL scrambles user data, including names, credit card numbers, and addresses, so that it cannot be read as it travels over the Internet. YOU AGREE THAT THE Spectronics Corporation PARTIES MAXIMUM LIABILITY ARISING FROM ANY PRODUCT SOLD BY Spectronics Corporation SHALL NOT EXCEED THE PRICE OF SUCH PRODUCT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTIONS LAW IS APPLICABLE TO THIS AGREEMENT.

Applicable Law

This offer and any subsequent sales agreement between Spectronics and Buyer shall be construed in accordance with the laws of the State of Nebraska.
